What is a Listing Agent Contract?
A Standard Exclusive Right to Sell Listing Agreement is the most common contract between a seller and a listing agent, giving the agent the exclusive right to market and sell the property—and earn a commission regardless of who finds the buyer.
Here are the key terms typically included:
- Names of the seller(s) and the brokerage/agent
- Establishes who is legally involved
- Full address and legal description of the property
- May include fixtures, exclusions, or personal property
- Start and end dates of the agreement
- Defines how long the agent has the exclusive right to sell
- The agreed-upon asking price
- May include authorization for price adjustments
- Specifies the commission amount or percentage paid to the broker who in turn pays the agent via the broker/agent contract
- Specifies the commission the seller is willing to pay to the listing broker who will in turn pay his agent (your buyer's agent). This may not be a part of the listing agreement, but it is a good idea to add to the listing agreement or use an addendum so the seller knows up front how much total commission they will need to pay at closing.
- States that commission is owed if the home sells during the contract period (even if the seller finds the buyer).
- If the seller finds the buyer, then the seller could avoid up to fifty percent of the agreed commission rate if they agreed to pay for the buyer's agent commission. This should be specified in the listing agreement or as an addendum.
